Terms of Service

1. Acceptance of Terms

By accessing or using the Better Home Project website at betterhomeproject.org and related services (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

Better Home Project reserves the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the Service after any modifications constitutes your acceptance of the revised Terms.

2. Description of Service

Better Home Project operates a platform that helps homeowners determine their eligibility for energy-efficient home upgrade programs. Our Service connects qualified homeowners with certified, pre-vetted local installation partners who provide home improvement services including, but not limited to, HVAC systems, roofing, solar panels, and water heaters.

Better Home Project is not a contractor, installer, or home improvement company. We are a referral and matching service. We do not perform any installation work, and we do not guarantee the quality, pricing, or availability of services provided by our installation partners. All work is performed by independent, licensed contractors.

3. Eligibility

To use our Service, you must be at least 18 years of age and a legal resident of the United States. By submitting a qualification form, you represent that you are the homeowner of the property in question or have authorization from the homeowner to inquire about home upgrade programs on their behalf.

4. Consent to Communications (TCPA Disclosure)

By submitting your information through our qualification form, you provide your prior express written consent under the Telephone Consumer Protection Act (TCPA), 47 U.S.C. § 227, and applicable state laws, to receive the following communications from Better Home Project and our certified installation partners:

  • Telephone calls, including calls made using an automatic telephone dialing system (ATDS) or prerecorded/artificial voice messages
  • Text messages (SMS and MMS), including messages sent using automated technology
  • Emails regarding your home upgrade inquiry and related services

These communications will be sent to the phone number and email address you provided and will relate to your home upgrade options, program eligibility, appointment scheduling, and related services.

You understand and agree that:

  • Your consent is not a condition of purchasing any goods or services.
  • Message and data rates may apply to text messages.
  • Message frequency varies based on your inquiry and interactions.
  • You may receive up to 10 messages per month.
  • You can opt out of text messages at any time by replying STOP.
  • You can opt out of phone calls by requesting to be placed on our do-not-call list.
  • For help with text messages, reply HELP or contact [email protected].

5. Information Accuracy

You agree to provide accurate, current, and complete information when using our Service. You understand that the accuracy of the information you provide directly affects the quality of the home upgrade options and partner matching we can offer. Providing false or misleading information may result in your disqualification from programs and termination of your access to the Service.

6. Third-Party Services & Partners

Our Service involves connecting you with third-party installation partners. You acknowledge and agree that:

  • Better Home Project does not control, endorse, or assume responsibility for the services, products, or actions of our installation partners.
  • Any agreements, contracts, or transactions between you and an installation partner are solely between you and that partner.
  • Better Home Project is not a party to any contract for home improvement services and is not liable for any disputes arising from such services.
  • Installation partners are independent businesses with their own licensing, insurance, and warranties.

7. No Guarantees

While we strive to match homeowners with quality installation partners and relevant upgrade programs, Better Home Project does not guarantee:

  • Eligibility for any specific program, rebate, incentive, or financing option.
  • Specific pricing, savings amounts, or cost estimates.
  • The quality, timeliness, or outcome of work performed by installation partners.
  • Availability of programs or partners in your area.

All estimates, savings projections, and program details provided through our Service are for informational purposes only and are subject to verification by the installation partner during an in-home consultation.

8. Intellectual Property

All content on the Service, including text, graphics, logos, images, and software, is the property of Better Home Project or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on the Service without our prior written consent.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BETTER HOME PROJECT, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES.

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100).

10. Indemnification

You agree to indemnify, defend, and hold harmless Better Home Project and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

11. Dispute Resolution

Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in the state where Better Home Project is headquartered. You agree to waive any right to a jury trial or to participate in a class action lawsuit.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Oklahoma, without regard to its conflict of law provisions.

13. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.
